Key words Belgian administrative law
Objectives The purpose is to give a survey of the working methods and the structure of the Belgian executive. Special attention is paid to the methods of legal protection against the authorities (the administrative appeal procedures, the ombudsmen, the Council of State, ...). The students should acquire the necessary skills to intermediate in situations of conflicts between the authorities and the citizen.
Prerequisites None.
Topics 1. survey of the most important legal norms (constitution, legislative acts, ...) and judicial review
2. the notion 'legal personality'
3. fundamental characteristics of the Belgian public services (centralization, decentralization, provinces, municipalities, supervisery competence, ...)
4. structure and competences of the social offices (ocmw)
5. legal position of the official compared to the legal position of the employee
6. legal protection against the authorities:
a. the right of access to public documents
b. the legal obligation to state the reasons for decisions
c. the ombudsmen
d. the administrative appeal procedures
e. the Council of State
7. the legal position of foreigners
